According to Fox-Davies, the "normal" way of displaying livery colours in flag form is showing the tincture of the main charge above that of the main
field (I am not quoting as I do not have my sources here right now). Most cases of
Landesfarben I have seen follow this rule, not only in Germany
(cf. Prussia, Brandenburg, former Westphalia, even the national flag) and Austria (black
eagle in yellow field) but also other non-German countries (cf. Poland).

The state flags (Landesflaggen) are frequently used in form of "state service flags"
(Landesdienstflaggen), also in the municipalities. As far as I know, only
Burgenland has a legal prescription: there the state and
state service flag are identical and open to general usage.
Practice frequently does not follow the legal prescriptions, though. In Vienna the "service flag", that is not provided in the law, is used by
hotels etc.
